State Supreme Court Quashes Act 13 Appeal by PUC

The state Supreme Court on Thursday issued an order quashing an appeal regarding the implementation of certain parts of Act 13—Pennsylvania's law governing Marcellus Shale drilling.

In October 2012, the Commonwealth court ordered the Public Utilities Commission to “cease and desist” from implementing certain parts of Act 13, specifically the provisions under which the agency would have a role in reviewing and approving municipal zoning ordinances.

The PUC appealed that order.

On Thursday morning the Supreme Court quashed that appeal —which means that the court will not be reviewing the matter.

Local communities—such as Cecil and Peters—had challenged Act 13 and are awaiting a ruling by the court regarding the legislation.
