Canon-McMillan School District, North Strabane Township Ordered to Pay $1.6 Million to Homeowners' Association

The judgment might be one of the largest ever awarded in Washington County.

The Canon-McMillan School District and North Strabane Township were ordered on Thursday to pay $1.6 million to a North Strabane homeowners' association.

According to the Observer-Reporter, a jury found the district violated the Stormwater Management Act by allowing sediment from a sports and recreation facility built in 1998 to drain onto McDowell Lane and into a pond.

The district must pay 60 percent and the township 40 percent of the verdict to the Glencannon Homeowners Association.

The district's insurance carrier will likely cover the cost of the judgment, according to a school official. 

Superintendent Michael Daniels said he would prefer not to comment because it it an ongoing legal matter.

Daniels indicated that counsel for both the district and the township have filed motions to have the award reduced to $500,000. A counter motion was also made by the plaintiff, and further court action is expected.

North Strabane Township Manager Frank Siffrinn said he wished to go over the court documents with legal counsel before commenting on the matter.

The newspaper reports the judgment might be one of the largest ever awarded to a plaintiff in Washington County.
